The following is some basic information you need to know when it comes to getting divorced in the State of Virginia. 

Residency Requirements for the State of Virginia:

One of the spouses must be a resident of Virginia for at least six months prior to filing for divorce.

 

Grounds for No-Fault Divorce:

Separation of Six Months: A final decree of divorce can be granted based upon a separation of six months if:

  1. The parties have entered into a separation agreement and
  2. There are no minor children born to the parties, born to either party and adopted by the other, or adopted by both parties.

 

Separation of Twelve Months: A final decree of divorce can be granted based upon a separation of twelve months if the parties have lived separate and apart without any cohabitation and without interruption for the full twelve months.  At least one of the parties must have intended for the separation to be permanent at the time it commenced. 

 

Where to File Your Divorce Action

In Virginia, parties have some flexibility as to where the divorce action can be filed.  The action can be filed in:

  1. the county in which the parties last lived together;
  2. the county where the Defendant resides or
  3. the county where the Plaintiff resides.

 

Rights to Former or Maiden Name:

Either spouse may restore his or her former name.  However, Virginia Code Sections 20-121.04 and 8.01-217 identify that a separate order must be filed to change a name.  Related Order documents, for use by each of the parties, have been provided (if such an action has been requested for each party).  A separate filing fee will be required.  As such, while Defendants do not typically appear as part of these divorce procedures, he or she must appear to provide the required additional filing fee if such a restoration or a prior name is requested.
